Surrey TRF have just launched a petition, to call upon Surrey County Council to improve the objectivity, impartiality and integrity of decision making on Rights of Way issues in Surrey.
This follows the recent and ongoing attempts by Councillors on the Guildford Local Committee, to make Traffic Regulation Orders (TROs) on Byways Open to All Traffic in Surrey, to prohibit law abiding motorists from using two particular rights of way in Surrey. This is despite the Council Officials writing detailed reports, concluding TROs were not appropriate and did not meet the councils own TRO Policy - on three occasions; and despite over 1000 letters of objection. The fact that local Parish Councillors lived on or near the roads in question did not have to be declared; Councillors were free to peddle prejudice and were not impartial nor based decisions on evidence. Whilst we're not there yet, but with a lot of effort, we're on the way to winning the battle over the TROs and ensuring the rule of law prevails.
Over the longer term TRF want to clean up the process so it is open, transparent, based on evidence and ensure that decisions are made by Councillors who are impartial and don't have vested undeclared interests.

Act Now - Proposed TRO - Byway 538 & 539 West Horsley - Objection Details
I urge everyone to write a letter and object to the proposed TRO's - if we do not object in vast numbers the local council will implement the TRO.
Surrey County Council Countryside Access team have stated that the Byways do not meet the Surrey CC TRO Policy, and recommend that they should be repaired, vegetation is cut back and speed advisory signs are erected instead of a TRO. However, they were overruled by the local council, who are determined to TRO the Byways.
There are two attachments:
1. All of the official council notification documents: Covering letter, maps, reasons for the TRO, how to object.
2. A TRF guidance document; stating who to write or email to, the facts, points and guidance, as to why they should not implement a TRO. This will help you write your letter and object to the TRO.
Please write or email and object, just few lines stating the main reasons will be fine. We must generate as many objections as possible.

Part of BOAT 116 Leatherhead has been TRO'd. From 20th October 2006 vehicles, including motorcycles
are banned from part of BOAT 116. The TRO runs from the Thirty Acre Barn, Shepherds Walk for 430 metres to
the junction with Bridleway 114.

A3 Hindhead Tunnel Gets Green Light - A multi-million pound tunnel underneath the Devil's Punchbowl
in Surrey has had the go-ahead from the government. Work on the A3 tunnel is set to be begin in January 2007.

A3 Hindhead Tunnel Scheme
Good news, the inspector ruled that BOAT 500 will remain as a BOAT.
It is not clear from the inspectors report exactly what will happen to BOAT 501.
The southern end of BOAT 501 could either become a cul-de-sac or connect to BOAT 500 at the eastern side of the old A3.
I am in the process of obtaining detailed drawings to determine this.

This consultation paper replaces the proposed Section 34a of the Road Traffic Act. It goes hand in hand with the proposed Restricted Byways. This proposal will seriously affect Trail Riding across England & Wales.

Highways Agency
Hatch Lane, South of Redhill, runs parallel to M23 :
Good news, the council have decided to put a Traffic Regulation Order (TRO) for cars only. Motorcycles will still be allowed to legally use the lane.
Byway Open To All Traffic (BOAT) 401, Honeycrock Lane to Cross Oak Lane Salfords, South of Redhill - Downgraded to Bridleway as of 6th October 2003
This is quite bizarre, due to an administrative error many years ago a small section of the route was never recorded as a BOAT. The council applied for the missing section to be upgraded to a BOAT, however the local farmer objected and it went to a public enquiry. After hearing all of the evidence the Inspector decided that it should remain as is, and so the original classification stands.
We have now had a second public enquiry and the inspector has ruled that the missing section will be a Bridleway. It gets worse: the existing BOAT has now been downgraded so that the whole length is now Bridleway.

Peeks Brook Lane, Horley: BOAT No 369, Horley
Surrey County Council announced their intention to put a TRO on this Byway,
due to the poor condition it has fallen into. After further investigation it
seems that its condition is mainly due to poor drainage. Several club members
have sent letters of objection to the Council, suggesting that a more appropriate
solution would be a temporary closure while drainage improvements are carried
out. Unfortunately Surrey CC did not agree with our solutions and have now put
a permanent TRO on this lane.
Jargon Explained:
Byway Open To All Traffic - BOAT
A BOAT can be used by any road legal vehicle.
Traffic Regulation Order - TRO
A TRO can be applied to a BOAT without changing the status, it prohibits vehicles, either cars and motorbikes or just cars. It is shown on the maps as a BOAT but will have signs at each end of the BOAT showing that it has a TRO. The sign is round with a red edge, and has a picture of either a motorcycle and car or just a car.
Proposed TRO's do not legally have to go to Public Enquiry when there are objections. If there is an overwhelming amount of objections it may go to a Public Enquiry, but even then it is up to the discretion of the council. This is why councils tend to put TRO's on BOATs instead of trying to downgrade them.
Public Enquiry
If there are objections to a change in status of a RoW, i.e. proposed downgrading of a BOAT, a Public Enquiry must be held. A Public Enquiry is run by a (supposedly) Independent Inspector, who is presented with evidence from both parties as to why a BOAT should/should not be downgraded. He will then go away and examine all of the evidence and make a decision.
A Public Enquiry can be held for any changes in the status of a RoW, including BOATs, Bridleways and Footpaths.
